Money Service Operators in Hong Kong are regulated by the Customs and Excise Department (C&ED) under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO). This framework ensures that license holders meet rigorous standards of business conduct, while maintaining the flexibility to adapt to an ever-evolving market.

Key Application Requirements

  • Company Eligibility: The applicant must be a Hong Kong-incorporated company (limited or unlimited liability) or an overseas company registered with the Hong Kong Companies Registry. Both residents and non-residents are eligible.
  • Fit and Proper Assessment: All directors and ultimate owners must pass a fit and proper assessment (covering criminal records, bankruptcy, liquidation, etc.). At least one director must pass the Customs competency exam. We recommend appointing 3 directors to sit it, as only one needs to pass. At least one director must be a Hong Kong resident.
  • Business Premises Registration: A designated premises accessible to Customs officers is required, supported by a stamped tenancy agreement and landlord’s consent for money service operations. For mixed commercial-residential buildings, written consent from all residents is required; purely residential buildings are not accepted. If no physical premises exist, a Local Management Office (LMO) and Local Place of Storage (LPS) must be established.
  • Document Requirements: Required documents include corporate documents (such as the Business Registration Certificate), personal particulars of all directors, partners, and ultimate beneficial owners, a business plan, AML and IT policies, and a power of attorney signed by all partners or board members for application submission.
  • Interview and Competency Assessment: Directors are required to sit the Customs competency assessment exam (approximately 2 to 3 months after application submission). This is followed by a Customs interview (approximately 5 to 7 months after submission), focused on the business model overview and AML compliance procedures.
  • Application Restrictions: Companies that have been declared bankrupt without having their rights restored, or companies managed by individuals with criminal records, are not eligible to apply for an MSO license.
